Welcome to collectivejiujitsuclub.com (the “Site”), operated by The Collective Jiu Jitsu Club (“The Collective,” “we,” “us,” or “our”). These Terms of Service (“Terms”) govern your access to and use of the Site and its content, forms, booking tools, communications, and related online services.

By accessing or using the Site, you agree to these Terms. If you do not agree, do not use the Site. We may update these Terms from time to time by posting a revised version with a new effective date. Your continued use of the Site after changes are posted means you accept the revised Terms.

These Terms govern use of the Site only. Participation in classes, memberships, events, purchases, waivers, and other services may be subject to separate agreements, policies, payment terms, and releases that you must review and accept.

1 Eligibility And Lawful Use

The Site is intended for adults and for parents or legal guardians acting on behalf of minors. You may use the Site only for lawful purposes and in compliance with these Terms and all applicable laws. If you access the Site from outside the United States, you are responsible for compliance with the laws that apply to you.

2 Permitted Use

You may access and view the text, graphics, images, videos, forms, documents, data, and other materials made available on the Site (“Content”) for your personal, non-commercial use. You may print or save reasonable copies for that purpose.

You may not reproduce, distribute, modify, publish, sell, license, exploit, or use the Site or Content for a commercial purpose without our prior written permission. No right, title, or interest in the Site or Content is transferred to you.

3 Information And Site Availability

We work to keep Site information useful and current, but we do not guarantee that Content will always be complete, accurate, current, error-free, secure, or continuously available. Class schedules, instructor assignments, program details, pricing, promotions, and availability may change.

Your use of Site information is at your own discretion. Contact us directly if you need confirmation of current class, membership, or scheduling information.

4 Bookings Accounts And Communications

You may use the Site or third-party services, including Zen Planner and Zen Planner Engage, to submit an inquiry, book a class, complete a waiver, register, create an account, or receive communications. You agree to provide accurate, current, and complete information.

You are responsible for safeguarding usernames, passwords, and other account credentials and for activity under your account. Notify us promptly if you suspect unauthorized access.

By submitting contact information, you authorize us and our service providers to contact you about your inquiry, booking, waiver, registration, membership, or related services. Marketing communications are governed by the consent language presented to you and our Privacy Policy. You may opt out of marketing emails using the unsubscribe link and may opt out of marketing text messages by replying STOP. Message and data rates may apply.

5 Purchases Memberships And Separate Agreements

Any purchase, membership, class package, recurring payment, cancellation, refund, freeze, waiver, or participation arrangement is governed by the separate agreement or policy presented during registration or purchase. If a separate agreement conflicts with these Terms regarding a purchased service or participation in training, the separate agreement controls for that subject.

Nothing on the Site guarantees acceptance into a program, class availability, a particular instructor, a particular result, or continued access to any membership or service.

6 Martial Arts Participation

Brazilian Jiu-Jitsu, Muay Thai, fitness activities, and related training involve physical exertion, close contact, and inherent risks of injury. Site Content is provided for general information and does not replace professional medical advice, diagnosis, or treatment. Consult a qualified healthcare professional before beginning a new exercise program or if you have questions about your ability to participate.

Participation requires completion of applicable waivers, releases, rules, and registration documents. A parent or legal guardian must complete required documents and provide required consent for a minor.

7 Intellectual Property

The Site, its Content, design, organization, logos, names, photographs, videos, graphics, and other materials are owned by or licensed to The Collective and are protected by copyright, trademark, and other intellectual-property laws.

“The Collective Jiu Jitsu Club,” our logos, and related marks may not be used without the prior written permission of the applicable owner. Nothing on the Site grants you a license to use any trademark or other intellectual property except as expressly permitted in these Terms.

8 Submitted Materials

If you voluntarily submit questions, reviews, feedback, suggestions, images, comments, or other materials (“Submitted Materials”), you represent that you have the right to submit them and that they do not violate any law or third-party right.

You grant The Collective a non-exclusive, worldwide, royalty-free license to use, reproduce, adapt, publish, display, and distribute Submitted Materials for lawful business purposes, subject to our Privacy Policy for personal information. This license does not apply to confidential payment information or information submitted solely to complete a waiver, registration, or private member record.

Do not submit material you consider confidential unless it is requested through an appropriate secure process.

9 Prohibited Conduct

You may not:

  • Interfere with, disrupt, damage, or attempt unauthorized access to the Site, accounts, systems, or networks
  • Probe, scan, or test vulnerabilities or bypass security or access controls
  • Introduce malware, malicious code, or harmful content
  • Scrape, harvest, or collect data from the Site by automated or unauthorized means
  • Impersonate another person or misrepresent your identity or affiliation
  • Post or transmit unlawful, fraudulent, defamatory, abusive, threatening, harassing, obscene, or infringing material

We are not responsible for the availability, content, security, products, or practices of third-party services. Comments and opinions posted by users on social media are their own and do not necessarily reflect the views of The Collective. Report inappropriate content on an external platform using that platform’s reporting process.

Our collection and use of personal information is described in our Privacy Policy, which is incorporated into these Terms by reference.

12 Disclaimers And Limitation Of Liability

THE SITE AND CONTENT ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE COLLECTIVE AND ITS OWNERS, OFFICERS, EMPLOYEES, INSTRUCTORS, CONTRACTORS, AGENTS, AFFILIATES, LICENSORS, AND SERVICE PROVIDERS DISCLAIM ALL EXPRESS, IMPLIED, AND STATUTORY WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE COLLECTIVE PARTIES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, LOSS OF DATA, LOSS OF PROFITS, LOSS OF GOODWILL, OR INTERRUPTION OF SERVICE ARISING FROM OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SITE OR CONTENT, REGARDLESS OF THE THEORY OF LIABILITY AND EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Some jurisdictions do not allow certain exclusions or limitations. In those jurisdictions, these provisions apply only to the extent permitted by law.

13 Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless The Collective and its owners, officers, employees, instructors, contractors, agents, affiliates, licensors, and service providers from claims, liabilities, damages, judgments, losses, and reasonable costs arising from your unlawful use of the Site, your Submitted Materials, or your material violation of these Terms or another person’s rights.

We may assume control of the defense of a matter subject to indemnification, and you agree to cooperate with that defense.

14 Suspension And Termination

We may suspend, limit, or terminate access to the Site or any Site feature at any time if reasonably necessary for security, maintenance, legal compliance, enforcement of these Terms, or protection of The Collective or others. Provisions that by their nature should survive termination will remain in effect.

15 Governing Law And Venue

These Terms are governed by the laws of the State of Idaho and applicable federal law, without regard to conflict-of-law rules. To the extent a dispute is not governed by a separate agreement, any legal proceeding relating to the Site or these Terms must be brought in a state or federal court with jurisdiction in Idaho, and you consent to that court’s jurisdiction and venue.

16 Miscellaneous

These Terms and the Privacy Policy constitute the agreement between you and The Collective regarding use of the Site, except where a separate agreement applies to a purchase, membership, waiver, or participation in services.

If a provision of these Terms is found unenforceable, it will be limited to the minimum extent necessary, and the remaining provisions will remain in effect. Our failure to enforce a provision is not a waiver. You may not assign your rights or obligations under these Terms without our written consent. We may assign our rights and obligations as part of operating or transferring our business.
